Commissioner for Oaths

$0.00

Authorized by the Province of Alberta and appointed according to the Notaries and Commissioners Act, a Commissioner for Oaths takes an oath when someone signs a statutory declaration or affidavit. These documents are sometimes referred to as Affirmations and Solemn Declarations. Instead of proving or disproving a statement, the Commissioner for Oaths ensures that the correct procedure was followed when the declaration or the affidavit was created and signed. Therefore, having a Commissioner for Oaths ensures legal compliance when you make an oath in a statement or an affidavit.

An affidavit is a sworn statement contained within a legal document. These documents must be verified by the oath of affirmation of the person making the statement.

A statutory declaration is a sworn statement contained within a document that is verified by the solemn declaration of the individual making the statement. This mechanism of verification is used when the legislative authority for an affidavit is absent.

In Alberta, a Commissioner for Oaths can administer oaths, affidavits, and solemn declarations for purposes such as:

  • Witness of signatures

  • Application for name change

  • Declaration of marriage status or single status

  • Land title transfer

  • Commission of Forms & Declarations

  • Statutory declarations for passport or travel document application

  • Consent letter for children travelling abroad

  • Letter of invitation for applications submitted to Immigration, Refugees and Citizenship Canada (IRCC)

  • Applications for professional licensing and registration, e.g., accounts and real estate agents

  • Translator's affidavit, which is attached to the translation file
